Ever-Power warrants only standaEPD and custom products of its manufacture against operational failure occurring during normal use and caused by defective materials or workmanship in its product.
StandaEPD product (listed in Ever-Power’s standaEPD products catalog) is warranted for 36 months from the date of purchase by Ever-Power’s customer or 30 months from the date the product is first put into service, whichever is earlier.
Custom product is warranted for 15 months from the date of purchase by Ever-Power’s customer or 12 months from the date the product is first put into service, whichever is earlier.
Ever-Power’s obligation is to replace free of charge any part of its product that its inspection shows to be defective including the lowest roundtrip transportation charges from Ever-Power’s customer to Sioux City, Iowa, and return, but excluding all transportation costs from Ever-Power’s customer to its customer and all other costs such as removal and installation expenses.
Ever-Power shall not be liable for loss of time, manufacturing costs, labor, material, loss of profits, consequential damages, direct or indirect, because of defective products, whether due to rights arising under the contract of sale or independently thereof, and whether or not such claim is based on contract, tort or warranty.
Written permission for any warranty claim return must be first obtained from authorized Ever-Power personnel. All returns must the accompanied with a complete written explanation of claimed defects and the circumstances of operational failure.
PRODUCTS MANUFACTURED OR SOLD BY Ever-Power ARE NOT WARRANTED EXPRESSLY OR BY IMPLICATION FOR MERCHANTABILITY OR FITNESS OR FOR ANY MEASURE OF SERVICE OR SUITABILITY OR FOR A SPECIFIC PURPOSE NOTWITHSTANDING ANY DISCLOSURE TO Ever-Power OF THE USE TO WHICH THE PRODUCT IS TO BE PUT. THIS EXPRESS WARRANTY IS THE SOLE WARRANTY OF Ever-Power. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE WARRANTY HEREIN EXPRESSLY SET FORTH. THE SALE OF PRODUCTS OF Ever-Power UNDER ANY OTHER WARRANTY OR GUARANTEE EXPRESS OR IMPLIED IS NOT AUTHORIZED.
(This warranty voids all previous issues.)
